General terms and conditions
1. General
The general terms and conditions of sale and delivery shall apply to all sales of products of PKM Konrad. Upon ordering, but at the latest upon acceptance of the goods, the
customer accepts these general terms and conditions of sale and delivery. Conflicting conditions of purchase of the buyer shall have no application even if they have not been
expressly contradicted.
2. Offers / agreements
2.1 PKM Konrad offers are non-binding. Delivery agreements come into force if the order is confirmed and/or has been executed by delivery of the goods.
2.2 The descriptions of the goods and technical information included in the product catalogue shall not be warranted properties. The right to amendments is reserved.
3. Delivery
3.1 PKM Konrad shall perform orders within the customary industry delivery periods unless any longer delivery periods were arranged in individual agreements. Claims to damages
on account of delayed delivery are excluded.
3.2 PKM Konrad shall not take back unsuitable or erroneously ordered articles.
3.3 Partial deliveries shall be permitted.
3.4 Delivery shall always occur on the account and risk of the buyer.
4. Prices / terms and conditions of payment
4.1 Prices shall be net prices without VAT, calculated in Swiss francs (CHF) or euros (€).
4.2 We shall case sell at the prices respectively offered. The right to changes in price due to price increases shall be reserved.
4.3 Invoices shall be due 30 days after invoice date without deduction.
4.4 The shipping and packaging costs shall not be included in the prices stated. They shall be charged additionally.
5. Reservation of title
5.1 The goods of PKM Konrad remain our property until payment of all of our claims, on whatever legal grounds.
6. Guarantee
6.1 PKM Konrad shall guarantee that its products are free from manufacturing and material defects.
Other guarantees shall be excluded. In the event of any defects, PKM Konrad shall decide at its discretion on substitute delivery or subsequent improvement. Other claims,
especially claims to damages, shall be ruled out.
6.2 The guarantee expires one year after delivery to the consumer. Non-expiry of the guarantee period must be proved by submission of the delivery slip or invoice.
6.3 We shall reserve the right to recall delivered goods or cancel deliveries if inspection in the case of suspected manufacturing defects and/or in the case of defects should be
necessary to avoid damage or for other reasons.
7. Place of performance
7.1 The place of performance for liabilities from this Agreement shall be CH-6343 Rotkreuz (Canton Zug).
8. Place of jurisdiction / applicable law
8.1 The exclusive place of jurisdiction for disputes arising from or in connection with this Agreement shall be
CH-6343 Rotkreuz (Canton Zug)
8.2 The applicable law shall be Swiss substantive law, to the exclusion of the Vienna Convention of the United Nations on Contacts for the International Sale of Good.
